SMS Messaging Terms and Conditions

These Messaging Terms govern the recurring SMS text-messaging program (the “Messaging Program”) operated by Anne Kepner_WVMC 3 (the “Committee,” “we,” “us,” or “our”). By affirmatively opting in to the Messaging Program, you agree to these Messaging Terms. Our Privacy Policy explains how we collect, use, disclose, and retain information.
1. Program Sponsor and Description
The Messaging Program sends recurring political and advocacy communications, campaign updates, voter-engagement information, election and event notices, volunteer opportunities, and donation solicitations. The messages sent will be consistent with the categories disclosed when you enroll.
2. Enrollment and Consent
You may enroll through the opt-in methods identified in the applicable call-to-action. Merely providing a mobile number, submitting an inquiry, or initiating a one-to-one text conversation does not enroll you in recurring campaign, advocacy, or fundraising messages unless you separately and affirmatively consent to receive those messages. Your consent is specific to the Committee and the Messaging Program described at enrollment; it is not transferable to another brand, affiliate, or organization.
By enrolling, you confirm that you are the account holder or customary user of the mobile number provided and are authorized to consent to messages at that number. Where disclosed, messages may be sent using automated technology. Consent is not a condition of making a donation, purchasing goods or services, receiving services, or submitting an inquiry.
3. Message Frequency
Message frequency varies, up to 8 messages per month.
4. Message and Data Rates
Message and data rates may apply. Your mobile carrier may charge fees for messages or data according to your wireless plan. We do not control carrier charges. Contact your carrier for plan details.
5. Opting Out
You may opt out at any time by replying STOP. We also honor QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE, and other reasonable requests that clearly communicate a desire to stop receiving messages. We will send one non-promotional confirmation message stating that you have been unsubscribed. After that confirmation, you will receive no further messages from the Messaging Program unless you later re-enroll.
Replying STOP will opt you out of the Messaging Program. You may also submit an opt-out request using the contact information below.
6. Help and Customer Care
For help, reply HELP to a message from the Messaging Program. You may also contact us at [Support Email] or MustHaveTheWebsite.vote. The HELP response will identify the Committee and provide a working support contact.
7. Privacy
Our Privacy Policy explains how we collect, use, disclose, and retain information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of disclosure exclude SMS opt-in data and consent; this information will not be shared with third parties or affiliates.
8. Your Responsibilities
You agree to provide an accurate mobile number and to notify us if you stop using or controlling that number. You should opt out before transferring or surrendering the number. You may not use replies or other interactions with the Messaging Program to transmit unlawful, threatening, abusive, fraudulent, or malicious content.
9. Availability and Delivery
Message delivery depends on your device, carrier, network availability, and other factors outside our control. Messages may be delayed, filtered, or undelivered. Mobile carriers are not responsible for delayed or undelivered messages. The Messaging Program may not be available on all devices or in all locations.
10. Program Changes or Termination
We may modify, suspend, or discontinue the Messaging Program and may update these Messaging Terms prospectively. Material changes will be posted on this page and communicated when required by applicable law. No amendment to these Messaging Terms will expand the scope of your SMS consent unless we provide any additional notice and obtain any additional consent required by applicable law or carrier requirements. You may opt out at any time by replying STOP.
11. Disclaimer and Limitation
To the maximum extent permitted by law, the Messaging Program is provided on an “as available” basis. We do not guarantee uninterrupted or error-free delivery. We are not responsible for losses caused solely by carrier outages, filtering, delayed delivery, an incorrect or reassigned number provided by you, or events beyond our reasonable control. Nothing in these Messaging Terms excludes rights or remedies that cannot lawfully be excluded.
12. Relationship to Other Terms
These Messaging Terms supplement any other terms that apply to your use of the Committee’s website or services. If another agreement conflicts with these Messaging Terms specifically concerning the Messaging Program, these Messaging Terms control to the extent permitted by applicable law.
